Terms & Conditions - the basics

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner. 

 

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).

Welcome to Baby Tot Tropicals (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of https://babytottropicals.com (the “Site”) and the purchase of products from us. By accessing or using our Site, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our Site or purchase our products.

2. Products

Baby Tot Tropicals sells live plants only.
Our plants are responsibly sourced, acclimated, and cared for prior to sale. Some plants are propagated using tissue culture techniques.

Because plants are living organisms:

  • Size, shape, color, and growth may vary

  • Natural imperfections and variations are normal

  • Photos shown represent the plant as accurately as possible at the time of listing but are not a guarantee of identical appearance

3. Orders & Availability

  • Orders are accepted as long as inventory is available

  • We reserve the right to refuse, cancel, or limit any order at our discretion

  • Prices are subject to change based on market value, but prices will not change after an order has been placed and paid

If an order is canceled after payment, a refund will be issued to the original payment method.

4. Pricing, Payments & Taxes

  • All prices are listed in U.S. Dollars (USD)

  • Prices exclude tax, which is calculated at checkout where applicable

  • Payment is required in full at checkout

We accept:

  • Major credit and debit cards

  • Apple Pay

  • Google Pay

  • PayPal and Venmo

Payment processing is handled securely by third‑party payment providers. We do not store full payment card details.

5. Shipping Policy

Shipping Times

  • Shipping timelines are estimates only

  • Tracking numbers are provided when available

  • We are not responsible for delays caused by carriers, weather, or circumstances beyond our control

Shipping Delays

We reserve the right to delay shipping due to:

  • Plant health considerations

  • Extreme weather conditions

  • Operational limitations

Any shipping delay will be communicated to the customer, and customers may choose how to proceed when delays are significant.

Address Accuracy

Customers are responsible for providing accurate and complete shipping information. We are not responsible for lost or delayed packages due to incorrect addresses provided by the customer.

6. Live Plant Disclaimer 🌿

By purchasing from Baby Tot Tropicals, you acknowledge that:

  • Plants may experience stress during transit

  • Minor leaf damage, color changes, or temporary decline can occur

  • Proper acclimation and care upon arrival are essential

We take reasonable steps to ensure plants are shipped healthy and alive.

7. Unboxing & Issue Reporting Requirements

To qualify for replacements, refunds, or returns:

  • Customers must unbox plants within 2–4 hours of delivery

  • Orders over $50 require signature confirmation

  • A clear unboxing video must be recorded and provided

  • Videos may be submitted via email or another agreed‑upon method

  • Customers must contact us directly first before searching online solutions so we can assist with troubleshooting

Notification Window

  • Issues must be reported within 2 days (48 hours) of delivery

  • After this period, orders no longer qualify for refunds, returns, or replacements

8. Returns, Refunds & Replacements

Because we sell live plants, all cases are handled individually under the rules stated above.

Depending on the situation, we may offer:

  • Replacement plants

  • Refunds

  • Store credit

The resolution is determined at our discretion after review of submitted evidence and communication with the customer.

9. Risk & Responsibility Transfer

  • Responsibility for the plant transfers to the customer once delivery is confirmed

  • We are not responsible for damage caused by:

    • Weather exposure after delivery

    • Improper care or handling

    • Delayed unboxing

    • Failure to follow care instructions

If external factors such as carrier handling or extreme weather may have impacted delivery, customers must contact us promptly so we can review the situation together.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Baby Tot Tropicals shall not be liable for indirect, incidental, or consequential damages

  • Our liability is limited to the purchase price of the product in question

This limitation does not apply where prohibited by law.

11. User Accounts

Customers may create accounts on our Site. We reserve the right to:

  • Suspend or terminate accounts for misuse

  • Cancel orders or restrict access for violations of these Terms

12. Intellectual Property

All content on this Site — including text, images, logos, and product photography — is the property of Baby Tot Tropicals and may not be copied, reproduced, or used without written permission.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
